Terms of Service

Sunshine Home Hero

These Terms of Service (“Terms”) govern all services provided by Sunshine Home Hero (“Company,” “we,” “us,” or “our”). By requesting, scheduling, authorizing, or receiving services from us, you (“Customer”) agree to these Terms.

1. Customer Information Requirements

To provide services, Customers must provide accurate and current contact information, including but not limited to:

  • Full name

  • Phone number

  • Email address

  • Service address

Failure to provide or maintain accurate information may result in service delays, rescheduling, or cancellation.

2. Payment Terms & Credit Card on File

A valid credit card on file is required for all customers.

  • Credit cards may be securely stored and used for deposits, recurring services, approved change orders, balances due, or unpaid invoices using our PCI compliant client database.

  • Payment terms will be outlined in estimates, proposals, or invoices.

  • Past-due balances may result in service suspension.

3. Large Projects, Deposits & Mechanic’s Lien Rights

For large, custom, or material-intensive projects:

  • A deposit is required, often up to 50% of the total project cost, prior to scheduling or ordering materials.

  • Final payment is due upon completion of the project unless otherwise stated in writing.

Non-Payment

  • Failure to remit payment may result in work stoppage or delayed project completion.

  • In the event of non-payment, Sunshine Home Hero reserves the right to pursue all legal remedies available, including the filing of a Mechanic’s Lien against the property where services or improvements were provided, in accordance with applicable state law.

  • Customer agrees to be responsible for any collection costs, including reasonable attorney’s fees, court costs, interest, and lien filing fees, as permitted by law.

4. Scheduling, Cancellations & Pauses

  • A minimum of 24 hours’ notice is required to cancel, pause, or reschedule:

    • Recurring services

    • Scheduled service visits

    • Project work

  • Cancellations or pauses with less than 24 hours’ notice may be subject to a service charge.

Weather conditions, safety concerns, or unforeseen site conditions may require rescheduling at the Company’s discretion.

5. Site Access & Gate Codes

  • Customer is responsible for providing safe and unobstructed access to all service areas.

  • If a gate is locked, a working gate code or access method must be provided prior to service.

  • If crews cannot access the property, the visit may be considered a completed service and billed accordingly.

6. Plant Warranty & Establishment Guarantee

Sunshine Home Hero stands behind its workmanship and offers the following limited guarantees:

Plant Material

  • A 90-day establishment guarantee is provided on plant material installed by Sunshine Home Hero.

This guarantee does not cover failure due to:

  • Under-watering or over-watering

  • Freezing temperatures or extreme heat

  • Drought, flooding, storms, hail, or wind damage

  • Pest infestation or disease beyond our control

  • Soil conditions not disclosed prior to installation

  • Acts of nature or acts of God

7. Sod Guarantee

  • A 6-week sod establishment guarantee is provided.

  • Within this period, sod should be healthy and well-rooted.

  • Any dead or brown areas due to installation-related issues will be replaced.

This guarantee does not cover damage due to:

  • Improper watering or drainage

  • Foot traffic before establishment

  • Pet damage

  • Freezing or extreme weather conditions

8. Change Orders

  • Any changes requested after work has begun may require a written change order.

  • Additional labor, materials, or time will be billed separately.

  • Work outside the original scope will not proceed without customer approval.

  • Change orders may be requested and approved via text, email, or system generated estimate.

9. Work Hours & Noise

  • Office Hours: Monday–Friday, 9:00 AM – 5:00 PM

  • Crew Work Hours: Typically 7:30 AM to as late as 8:00 PM, depending on weather, daylight, and project needs.

Customer acknowledges that landscaping and construction services may involve noise, equipment, and temporary disruption.

10. Property Conditions & Underground Items

Customer is responsible for identifying or marking:

  • Sprinkler systems

  • Drain lines

  • Electrical or low-voltage wiring

  • Invisible fencing

  • Septic systems or tanks

Sunshine Home Hero is not responsible for damage to unmarked or undisclosed underground items.

11. Customer Satisfaction & Resolution

We stand by our work and are committed to customer satisfaction.

  • Any concerns must be reported promptly to allow us the opportunity to inspect and resolve the issue.

  • Sunshine Home Hero reserves the right to correct deficiencies before third-party repairs are performed.

  • Our goal is always a fair, reasonable, and professional resolution.

12. Limitation of Liability

Sunshine Home Hero shall not be liable for indirect, incidental, or consequential damages. Liability for any claim shall not exceed the amount paid for the specific service provided.

13. Termination or Refusal of Service

Sunshine Home Hero reserves the right to refuse or terminate service for reasons including, but not limited to:

  • Non-payment

  • Unsafe or hostile working conditions

  • Repeated last-minute cancellations

  • Misrepresentation or abuse of staff

14. Agreement & Acceptance

By scheduling services, submitting payment or deposits, signing a proposal, or allowing work to proceed, Customer acknowledges and agrees to these Terms of Service.
